New Delhi: The Delhi High Court has granted interim bail to former Jawaharlal Nehru University student activist Umar Khalid for three days, allowing him temporary release in connection with the 2020 North East Delhi riots larger conspiracy case under the Unlawful Activities (Prevention) Act.

Court Order and Bench Observation

The division bench comprising Justice Prathiba M Singh and Justice Madhu Jain allowed Khalid's plea permitting him to be released between June 1 and June 3 on strict conditions citing humanitarian considerations.

Arguments Before the Court

Senior Advocate Trideep Pais, appearing for Khalid, argued that he had previously been granted short term bail for family events and humanitarian reasons The defence emphasised his request to attend his mother's surgery and uncle's Chehlum ceremony.

Prosecution Stand

Opposing the plea Additional Solicitor General SV Raju representing the Delhi Police stated that Khalid's mother's surgery was minor and that his sisters were available to care for her He suggested escorted hospital visits instead of interim release.

Conditions of Bail

The court directed that Khalid must use only one mobile phone remain in constant contact with the Investigating Officer and comply with all conditions to be detailed in the final order.

Significance

The order reflects the court's consideration of humanitarian grounds while balancing procedural restrictions in a sensitive criminal case.

Background Context and Next Steps

Issues surrounding the case relate to allegations of a larger conspiracy in the 2020 North East Delhi violence which has been under judicial scrutiny for several years The interim bail does not affect the merits of the ongoing trial and Khalid will return to custody after the permitted period unless further relief is granted by the court.

In future hearings Further detailed conditions of bail will be issued in the court's written order and compliance will be monitored by investigating authorities during the interim release period This decision was taken after hearing both parties extensively in open court proceedings on Friday in Delhi India today.
