New Delhi: Divorce proceedings are not only emotionally difficult but also involve detailed legal and financial scrutiny. Lawyers and courts rely heavily on documentation while deciding issues related to maintenance, child custody, property division and other claims.
Legal experts advise individuals planning to seek divorce to begin collecting important records well before filing a case.
The marriage certificate is considered the primary proof of marriage. In Muslim marriages, the nikahnama serves as the main legal document. If the marriage was not formally registered, wedding photographs, invitation cards and other ceremony-related records may also be required.

For business owners or self-employed individuals, GST filings, profit-and-loss statements and partnership documents may also become relevant.
In cases involving matrimonial property disputes, documents such as sale deeds, lease agreements, home loan papers, registration records and property tax receipts become important evidence.
Courts may also examine the lifestyle and financial condition of the family during the marriage. Utility bills, rent receipts, school fees, medical expenses, travel costs and credit card statements can help establish spending patterns and financial responsibilities.

In contested divorces, evidence supporting allegations such as cruelty, desertion, adultery or domestic violence may be required.
Medical reports, police complaints, photographs, emails, messages and court records are often submitted as supporting material. Legal experts stress that evidence should always be collected lawfully and without violating privacy rules.
Where child custody disputes arise, courts focus on the welfare of the child. Parents may need to provide school reports, medical records, vaccination details and documents showing involvement in the child’s upbringing.
