New Delhi: The controversy surrounding the CJP protest in Delhi has taken a significant turn after the Supreme Court Bar Association (SCBA) urged Chief Justice of India Surya Kant to intervene urgently over the reported detention of several advocates, including senior lawyers, young practitioners and women advocates.
In a resolution passed on Saturday, October 10, the SCBA expressed serious concern over allegations of excessive police force against lawyers who were reportedly protesting peacefully in the Supreme Court area. The association also raised concerns about the detention of advocates and called for immediate steps to establish their whereabouts and ensure their safety.
The development has brought the handling of the protest under renewed scrutiny, with questions emerging over police action, the treatment of demonstrators and the legal safeguards available to individuals taken into custody.
The SCBA has requested the Chief Justice to take up the matter with the concerned authorities without delay. Its resolution calls for confirmation of the whereabouts and safety of every detained advocate, along with access to legal assistance for those in custody.
The association has also sought the immediate release of individuals against whom there are no lawful grounds for detention. It has called for the circumstances surrounding the reported detentions and use of force to be examined, with appropriate action taken in accordance with the law.
The intervention sought by the SCBA places the matter before the head of the Indian judiciary for urgent consideration. However, the association’s request does not, by itself, establish whether the Chief Justice has issued any directions or whether the detained lawyers have been released.
The association’s resolution has specifically highlighted concerns about the reported treatment of senior and young advocates, particularly women lawyers, during the protest.
