A Special Executive Magistrate (SEM) court in Delhi on Wednesday ordered the release of Cockroach Janta Party (CJP) activists Saurav Das and Ashutosh Ranka after accepting the sureties furnished on their behalf.

Assistant Commissioner of Police (ACP) Ritu Raj, acting as the SEM, passed the release order. Delhi Police had earlier sought a three-day extension of the judicial custody of the two activists.

Detained after Jantar Mantar protest

Police detained Das and Ranka on October 13 after they climbed the gates of the barricaded protest site at Jantar Mantar. The following day, they were remanded to judicial custody for five days, which was extended by another two days on October 19.

In its October 19 order, the SEM court had observed that the conduct of the two activists showed they had no respect for the law. It also expressed serious concerns over the possibility of their actions disturbing peace and tranquillity.

Court raised concerns over repeated protests

The court said the activists had shown "habitualness" by calling for protests in de-notified areas. It also rejected the sureties submitted for Das and Ranka, finding them unfit.

After the extended custody period ended on Wednesday, the two activists were produced before the SEM court, which subsequently ordered their release after accepting the sureties.

High Court petition withdrawn

Das and Ranka had also challenged the SEM court's October 19 order before the Delhi High Court. However, they withdrew their writ petition after Justice Subramonium Prasad observed that the SEM court was already seized of the matter and that a revision plea would be a more appropriate remedy if they did not receive relief there.

Advocates Abhik Chimni and Pranjal Abrol represented Das and Ranka before both the SEM court and the Delhi High Court.
