New Delhi: In a significant development in the 2017 Unnao rape case, the survivor has announced that she will approach the Supreme Court against the Delhi High Court’s (HC) decision to suspend the jail term of expelled BJP leader Kuldeep Singh Sengar.

Speaking on Wednesday, the survivor described the HC verdict as “kaal (death)” for her family, highlighting the deep fear and insecurity the order has created.

High Court’s Bail Order and Conditions

On Tuesday, December 23, the Delhi High Court suspended Sengar’s life imprisonment sentence in the rape case and granted him bail while his appeal against the 2019 trial court conviction is pending.

However, the court imposed strict conditions to ensure the safety of the survivor, including a prohibition on Sengar approaching within 5 kilometers of the victim’s residence and a ban on threatening her or her mother. The order further stipulated that any violation of these conditions would result in the automatic cancellation of bail.

Despite the suspension of his sentence in the rape case, Sengar will remain in jail due to a separate 10-year sentence in connection with the custodial death of the survivor’s father, for which he has not been granted bail.

Survivor Voices Concerns Over Safety

The survivor, who was a minor when she was kidnapped and raped by Sengar in 2017, expressed grave concern over her family’s security. She noted that protection for her family members, lawyers, and witnesses had already been withdrawn, which intensified her sense of vulnerability.

She criticized the decision, saying, “If the convict gets bail in cases like this, how will the country’s daughters remain safe? For us, this decision is no less than ‘kaal’ (death). Those with money win, those without money lose.”

Plans to Protest and Seek Justice

The survivor, accompanied by her mother, planned to stage a protest near Mandi House in Delhi to voice opposition to the HC order. She confirmed her intention to challenge the verdict in the Supreme Court, underlining her determination to ensure that justice is served.

The 2017 Unnao rape case, along with related incidents, had been transferred from Uttar Pradesh to Delhi following Supreme Court directives in August 2019, to ensure a fair trial. This latest development underscores ongoing concerns over victim safety and accountability in high-profile criminal cases.
