Swatantra Bhardwaj case reaches court as investigation enters crucial phase
New Delhi: A Delhi court on Saturday sent social media influencer Swatantra Bhardwaj to one-day police custody in the alleged assault case linked to the July 20 CJP protest, bringing a major twist to the controversy. His arrest by Delhi Police followed a viral interview, fresh POCSO FIR, SC/ST Act charges and allegations involving online threats to a minor activist, turning the case into a national talking point.
The action came shortly after Delhi Police detained Bhardwaj from Uttar Pradesh’s Bulandshahr and produced him before the Patiala House court. The development has intensified the investigation into allegations of assault on Sanjay Azad, the father of minor activist Nishu Azad, during the Cockroach Janta Party (CJP) protest at Delhi’s Jantar Mantar.
The case, which started as a protest-related clash, has now expanded into a wider legal and political controversy involving allegations of violence, social media statements, online harassment and questions over accountability.
The matter is linked to the CJP protest held at Jantar Mantar on July 20, where Sanjay Azad had reached along with his daughter. According to the complaint filed with Delhi Police, an argument broke out after some people allegedly questioned Azad about recording videos at the protest site.
The disagreement reportedly escalated into a physical confrontation, during which Azad suffered injuries to his head. The initial FIR registered at Parliament Street Police Station mentioned charges related to causing hurt and wrongful restraint under the Bharatiya Nyaya Sanhita (BNS).
However, the case gained fresh attention after allegations surfaced that the incident involved more serious offences. Supporters of Sanjay Azad demanded stronger action and questioned the initial police response.
The investigation gained momentum after clips from an interview and podcast featuring Swatantra Bhardwaj went viral on social media.
In the videos, Bhardwaj allegedly spoke about the confrontation and made remarks regarding the incident, triggering strong reactions from activists, political groups and social media users.
The viral content increased pressure on Delhi Police to examine the statements and investigate whether the remarks matched the evidence collected during the probe.
Bhardwaj later claimed that his actions during the protest were in self-defence and said he acted to protect himself during the confrontation. Police are now examining digital evidence, witness statements and other material linked to the case.
Following protests demanding action against him, Delhi Police detained Bhardwaj from Bulandshahr in Uttar Pradesh.
The detention took place after CJP supporters and political representatives staged a protest outside Parliament Street Police Station, demanding immediate police action in the alleged assault case.
After his detention, Bhardwaj was arrested and produced before the Delhi court, which granted one-day police custody to allow further investigation.
During the custody period, police are expected to question him regarding the alleged assault, viral statements, digital content and other complaints registered against him.
The controversy escalated further after Delhi Police registered a separate FIR under the Protection of Children from Sexual Offences (POCSO) Act. The case was filed following a complaint by the minor activist alleging online threats, harassment and abusive messages after she spoke publicly about the alleged assault on her father.
The FIR also includes relevant provisions under the Bharatiya Nyaya Sanhita and Information Technology Act. Investigators are examining allegations related to online intimidation, cyber harassment, stalking and threats. Since the complaint involves a minor, police are following special legal procedures during the investigation.
Delhi Police has also added provisions under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act along with criminal intimidation sections in the assault-related FIR. The move came after allegations that caste-related remarks were made during the confrontation.
CJP representatives had earlier approached police officials demanding stronger legal action, including additional sections in the FIR and a detailed investigation into the allegations.
After Bhardwaj’s detention and arrest, security arrangements were increased outside Parliament Street Police Station. Police placed barricades at strategic locations and deployed additional security personnel after supporters gathered at the spot to protest against the action. Authorities kept the area under observation to prevent any law and order situation.
The case also attracted political attention after Bhardwaj referred to his alleged association with political personalities during social media interactions. Union Minister Chirag Paswan later distanced himself from the controversy and filed a complaint seeking a fair investigation into the matter.
The political angle added another layer to the dispute, with the case now involving allegations of assault, online threats, social media influence and questions of responsibility.
Earlier, Delhi Police had stated that Sanjay Azad suffered injuries during a scuffle and that the injuries were caused by a steel bracelet.
Police had initially described the injuries as simple in nature. However, after fresh complaints, viral statements and public pressure, investigators expanded the scope of the probe.
Authorities are now reviewing medical records, digital evidence, witness statements and other material before deciding on further legal action.
The Swatantra Bhardwaj case has triggered a wider debate over the growing influence of social media personalities in political and public movements.
The controversy has raised questions about online responsibility, the impact of viral videos on investigations and the challenges faced by law enforcement agencies when protests and digital platforms overlap.
While supporters of the complainant are demanding strict action, Bhardwaj’s supporters have maintained that the investigation should remain fair and unbiased.
