
HAF Challenges California Agency Over ‘Caste Equals Hinduism’ Claim
Washington: A new controversy has arisen in the United States over the linking of caste and Hinduism. The Hindu American Foundation (HAF) has filed a lawsuit against the California Department of Civil Rights (CRD) in the US Court of Appeals. The Foundation alleges that the CRD has wrongly linked caste discrimination to Hinduism and people of Indian origin, thereby targeting a specific community.
HAF filed a counter-petition in the Ninth Circuit Court of Appeals on April 6th. It stated that the lower court did not thoroughly investigate the issue when dismissing their case. The Foundation has appealed to the court to rehear the case and seriously consider their allegations.
HAF argues that the CRD's actions directly link "caste" to Hinduism and people of Indian or South Asian origin. This sends the message that the issue is specific to a specific community, which is inaccurate and discriminatory.
This controversy stems from a lawsuit filed by the California Department of Civil Rights against tech company Cisco Systems and two of its managers. The case alleged caste-based discrimination. The CRD argued that the company should have prevented caste discrimination among its South Asian employees.
HAF accused the CRD of misrepresenting "India's caste system" as a "Hindu social and religious structure," which is false and misleading. Although the CRD later removed the statement, the HAF maintains that the underlying problem remains.
HAF Senior Legal Director Nidhi Shah stated that the impact of this case will not be limited to this one case. She stated that there is growing concern about this issue within the Hindu, Indian, and South Asian communities. They allege that the CRD is using its powers to target the very communities it is supposed to protect.
Experts believe the decision in this case could shape the future direction of the relationship between caste and religion in American law. This issue is already sensitive, especially in the tech sector, which employs a large number of South Asians.
