Bofors Case Ends After 40 Years: Hinduja Brothers Get Final Relief (Img: Pinterest)
New Delhi: Almost four decades after starting legal proceedings, investigations and political debates, the Bofors controversy seems to have been resolved at last. The apex court of the country has thrown out the final plea against the acquittal of the Hinduja brothers and Swedish weapons company AB Bofors.
However, the Bofors controversy had become much more than the sale of a gun. It turned into a matter of political allegation and corruption debate.
The controversy began in 1987, when Swedish Radio reported allegations of illegal payments in India’s purchase of 400 155 mm Bofors howitzer guns from Swedish company AB Bofors.
The deal, signed in 1986, was considered crucial for strengthening the Indian Army’s artillery capabilities. However, allegations of commissions and middlemen soon turned the defence agreement into a major political crisis.
The controversy severely affected the image of then Prime Minister Rajiv Gandhi’s government and became one of the biggest issues during the 1989 Lok Sabha elections.
A number of people and firms came into the picture during the investigation, which included the Hinduja brothers, Srichand, Gopichand and Prakash Hinduja. The CBI charged the Hinduja brothers with participation in any illegal activity related to the deal. But, the Hinduja brothers refuted the charges all along.
In 2005, the Delhi High Court acquitted the Hinduja brothers and AB Bofors of criminal cases as the case of the prosecution was doubtful. The CBI appealed against the verdict but the Supreme Court rejected the appeal of the CBI in 2018 for filing the petition after 4,500 days.
The Bofors case was registered by the CBI in 1990 in which several individuals were charged with offences like corruption, cheating, and criminal conspiracy.
Over time, there have been several turns in this case. Some of the main accused in the case, including the middlemen Win Chadha and Ottavio Quattrocchi, have died due to the prolonged legal battle.
A Supreme Court bench comprising Justice JB Pardiwala and Justice K Vinod Chandran recently refused to entertain the final challenge against the acquittal order.
The court questioned the prolonged litigation and noted that the matter had remained pending for years.
With this dismissal, the legal proceedings against the Hinduja brothers and AB Bofors come to an end.
The Bofors controversy changed the way India looked at defence deals and political accountability.
It became one of the first major defence scandals to dominate national elections and pushed demands for greater transparency in military procurement.
While the courtroom battle has ended after 40 years, the Bofors case remains etched in India’s political history as the controversy that transformed public debate around defence contracts.
