Ritabrata Banerjee stays as Bengal LoP after Calcutta High Court interim verdict
Kolkata: The political battle inside the Trinamool Congress has entered a fresh phase after the Calcutta High Court allowed rebel TMC MLA Ritabrata Banerjee to continue as the Leader of Opposition in the West Bengal Assembly for now. The court refused to disturb the Speaker’s decision at this stage and ordered a detailed hearing on the appointment dispute within two months.
The interim order by a division bench of Justices Shampa Sarkar and Ajay Kumar Gupta has provided temporary relief to Ritabrata Banerjee but has kept the larger controversy unresolved. The case has become a major political flashpoint as two rival groups within the Trinamool Congress have been fighting over control of the Opposition leadership position in the Assembly.
The court’s decision means Ritabrata Banerjee will continue to perform his duties as Bengal’s Leader of Opposition until the single bench delivers its decision on the legal challenge.
The controversy began after West Bengal Assembly Speaker Rathindra Bose recognised Ritabrata Banerjee as the Leader of Opposition, despite another claim from senior TMC MLA Sobhandeb Chattopadhyay, who is associated with the Mamata Banerjee-led faction.
Chattopadhyay challenged the Speaker’s decision before the Calcutta High Court, questioning the procedure followed in selecting the Leader of Opposition.
Earlier, the court had refused to grant immediate relief against Ritabrata Banerjee’s appointment, allowing him to continue in the post while examining the larger legal issues involved.
The latest order has now shifted the focus towards the final hearing, where the court will examine whether the Speaker followed the correct constitutional and procedural process while recognising the LoP.
The dispute over the Leader of Opposition post reflects the deeper internal conflict within the Trinamool Congress. The Mamata Banerjee camp had backed Sobhandeb Chattopadhyay for the position and communicated its claim to the Assembly Speaker. However, another group of TMC MLAs claimed majority support inside the legislature party and proposed Ritabrata Banerjee as the Opposition leader.
The Speaker accepted Ritabrata Banerjee’s claim after considering the support shown by MLAs backing him. The rebel group had claimed support from a majority of TMC legislators in the Assembly. The rival faction challenged the move, arguing that the Speaker should have considered the party’s original recommendation and followed a broader consultation process before making the appointment.
The LoP dispute also became linked with allegations of signature irregularities in documents submitted before the Assembly Speaker. Ritabrata Banerjee, along with Deputy Leader of Opposition Sandipan Saha and other rebel MLAs, alleged that signatures supporting Sobhandeb Chattopadhyay’s claim were not genuine.
The controversy, popularly referred to as the “signgate” issue, has added another layer to the ongoing political confrontation and is being examined by the West Bengal Police CID. The investigation into the alleged signature controversy has further intensified the differences between rival groups within the TMC.
The legal battle has raised important questions about the role and powers of the Assembly Speaker while deciding the Leader of Opposition. During earlier proceedings, the court examined whether the Speaker should have given priority to the political party’s decision or whether the numerical strength of MLAs within the legislature party should determine the LoP.
The supporters of Ritabrata Banerjee argued that the Speaker was right in recognising the leader who had the backing of the majority of opposition legislators. They maintained that the Leader of Opposition represents the strength of lawmakers inside the Assembly and that the Speaker has the authority to recognise the person commanding majority support.
The opposing side argued that the political party’s official decision cannot be ignored and that the legislature party and the political organisation have different roles.
The High Court’s interim order has brought temporary stability to the Opposition leadership in the West Bengal Assembly but has not ended the political battle.
For Ritabrata Banerjee’s supporters, the order is being seen as a continuation of their claim over the Opposition leadership post. For the Mamata Banerjee faction, the legal challenge remains a key opportunity to contest the Speaker’s decision and reclaim control over the LoP appointment process. The final verdict could have wider implications for the balance of power within the TMC legislature party and may influence the political narrative in West Bengal.
The Leader of Opposition position holds significant importance in any state Assembly as it represents the main political challenge to the government. The LoP plays a crucial role in legislative debates, scrutiny of government policies, committee appointments and democratic oversight.
