SC refuses Mamata-led TMC plea over frozen accounts (Img: Dynamite News)
New Delhi: In a significant setback to the Trinammol Congress faction led by former West bengal Chief minister Mmata banerjee, the Suprme court on Thursday dismissed a plea seeking permission to operate four debit-frozen party bank accounts.
A bench consists of Justices M M Sundresh and P B Varale declined to interfere with the Caucutta High court order that had earlier refused the request.
The apex court observed that the entitlement to funds in the bank accounts cannot be decided while the party's election symbol dispute remains pending before the Election Commission of India.
"The Election Commission has frozen the symbol and therefore the larger issue as to who is entitled to the amounts is pending for adjudication", the bench noted, directing that the accounts will remain frozen until the question of entitlement is settled.
Counsel for the Banerjee-led faction had argued that debit freeze was severely affecting the party's day to day functioning and sought interim relief to operate the accounts. The court, however, found no ground to grant the prayer.
The accounts were frozen folloing the Election Commission's decision to freeze the party's symbol amid an internal dispute.The faction had first approached the Calcutta High Court for permission to operate them; after the High Court declined to entertain the plea, the matter reached the Supreme Court.
