Supreme Court To Hear Pleas Challenging CEC Gyanesh Kumar, SIR On October 5

The Supreme Court will hear pleas on October 5 challenging aspects of CEC Gyanesh Kumar’s functioning, ECI decision-making and the Special Intensive Revision of electoral rolls.

New Delhi: The Supreme Court is scheduled to hear on October 5 a batch of petitions questioning the functioning of Chief Election Commissioner Gyanesh Kumar and decisions linked to the Special Intensive Revision (SIR) of electoral rolls.

The matter is listed before a bench headed by Chief Justice of India Surya Kant, along with Justices Joymalya Bagchi and V. Mohana. The court’s official cause list confirms the bench for October 5.

Pleas Raise Questions Over ECI Decision-Making

The petitions challenge the manner in which certain decisions were allegedly taken within the Election Commission. One plea raises questions over whether the Chief Election Commissioner could take decisions concerning electoral rolls and related matters without the concurrence of the other Election Commissioners.

The petitioners have referred to alleged objections by Election Commissioners Sukhbir Singh Sandhu and Vivek Joshi over issues including Form 6, voter registration, electoral-roll changes and the management of voter data. These are allegations made in the petitions and are yet to be adjudicated by the court.

Plea Seeks Probe Into SIR-Linked Decisions

Another petition filed by lawyer Shailendra Mani Tripathi seeks an independent judicial inquiry or an SIT headed by a retired Supreme Court judge. It also seeks technical and forensic scrutiny of ECINet and ERONet systems and an investigation into electoral-roll changes linked to the SIR exercise.

The petitioner has also sought legal action against the CEC and other officials if violations of statutory duties are established. These remain prayers and allegations before the court, not findings by the Supreme Court.

Suspension Of CEC Also Sought

A separate plea has sought interim suspension of Gyanesh Kumar from functioning as Chief Election Commissioner while the case is pending. The petition also challenges decisions allegedly taken without the concurrence of the other Election Commissioners.

The October 5 hearing could therefore bring several questions surrounding the ECI’s decision-making process, the SIR exercise and the powers of the three-member poll panel before the Supreme Court.
