No Threats, No Late-Night Calls: RBI Tightens Loan Recovery Rules, Protects Borrowers From Harassment

New Delhi: The Reserve Bank of India (RBI) has introduced a stricter framework for loan recovery practices, aimed at preventing borrowers from facing harassment, intimidation and unfair recovery methods during EMI defaults.

Under the new rules, banks, non-banking financial companies (NBFCs) and other regulated lenders will have to follow clear guidelines while contacting borrowers, appointing recovery agents and using technology-based recovery measures. The revised framework will come into effect from January 1, 2027.

Loan Recovery Calls Restricted to Specific Hours

One of the major changes introduced by the RBI is a fixed time window for borrower communication. Under the new norms, lenders and recovery agents will generally be allowed to contact borrowers only between 8 am and 7 pm.

Any communication outside these hours will require specific consent or a request from the borrower. The move aims to prevent repeated calls, late-night harassment and pressure tactics used by some recovery agents.

Recovery Agents Cannot Use Threats or Public Shaming

The RBI framework strictly prohibits recovery agents from using abusive, threatening or intimidating language while seeking loan repayments.

Agents will not be allowed to:

  • Threaten borrowers or their family members
  • Repeatedly contact borrowers in a harassing manner
  • Publicly shame defaulters
  • Reveal personal loan details to third parties

The central bank has also restricted the misuse of social media platforms for debt recovery. Lenders and agents cannot upload or circulate borrowers’ personal information, photographs, videos or audio recordings to pressure them into making payments.

Special Protection During Sensitive Situations

The new guidelines also instruct lenders and recovery agents to show sensitivity while dealing with borrowers. Agents should avoid contacting borrowers during difficult personal circumstances such as medical emergencies, bereavement or important family events like marriages.

RBI Brings Technology-Based Recovery Under Rules

The RBI has also included technology-driven recovery methods within the regulatory framework. This includes restrictions related to remote locking of financed electronic devices such as smartphones, tablets and laptops. However, such measures can only be used when the loan was specifically taken to purchase that particular device.
