Prayagraj: Allahabad High Court in a landmark verdict has clarified that the security cannot be provided to the couple only on the basis of their 'secret marriage', reports Dynamite News correspondent.
Such couples who elope and marry have to prove that there is a real threat to their life and freedom, only then appropriate steps will be taken for their state protection.
Infact, the High Court observed that such couples who marry 'this way' must face the pressures of society.
This verdict by Justice Saurabh Srivastava came on the petition of Shreya Kesarwani of Chitrakoot. Shreya had appealed to the High Court to give her protection in case of interference by 'opponents' after her marriage.
Shreya in her petetion alleged that she and her partner are adults and they got married against the wishes of their family.
And therefore, she feared that her family members could harm her. She further alleged that earlier to she had faced the abuse from her family members.
While disposing of the petition, the High Court said that the petitioners had applied for security to SP Chitrakoot, but there is no fact on record which shows that they are in serious danger.
The Court also said that no evidence of any kind of physical or mental attack against the petitioners has been presented by the opponents.
The Court made it clear that the police has the right to provide security only in cases where there is a real threat. If a crime has occurred, there is a provision to register an FIR in the concerned police station, which has not been done in this case.
Therefore, there is no case for providing police protection.
