Uttar Pradesh: The Uttar Pradesh government has tightened character verification rules for candidates seeking government jobs, potentially affecting individuals involved in violent activities. The revised guidelines, which apply to direct recruitment across state government departments, corporations, councils and local bodies, are aimed at changing the existing political or social order.
The rules, issued by the Appointment and Personnel Department under Principal Secretary M Devaraj, follow directions from the Allahabad High Court. The decision has triggered a political controversy, with Opposition parties raising concerns about democratic rights, peaceful protests and government recruitment.
Under the revised framework, candidates involved in activities intended to overthrow the existing order through violence may be considered ineligible for government employment. Activities undertaken during the three years preceding character verification, when the individual was at least 21 years old, may indicate continued involvement.

However, authorities may reconsider this assessment if concrete evidence demonstrates a positive change in the candidate's conduct.
The guidelines clarify that political ideology alone cannot be grounds for denying someone a government job. Authorities must distinguish between peaceful political participation and involvement in violent activities.
The new guidelines clarify that registering a First Information Report (FIR) or having a pending criminal investigation will not automatically disqualify an applicant. Acquittals, cases resolved through compromise and matters covered under juvenile justice law will also not automatically result in disqualification under the specified provisions.
However, candidates must satisfy the applicable recruitment requirements, and individual circumstances may be examined during verification.
Appointing authorities may issue provisional appointment letters while character verification reports are pending, subject to the required self-declaration and documentation. Such appointments remain conditional, and false disclosures or established ineligibility may lead to cancellation and further legal action.
Existing government employees will not ordinarily require fresh character verification under the revised framework. Authorities may seek relevant information from their previous departments when necessary.
District police and Local Intelligence Units (LIUs) must submit verification reports within 30 days of receiving a request. The Home Department will monitor delays. Routine physical visits to candidates' residences have also been removed, and applicants need not be physically present during verification.
If a report contains adverse findings, the district magistrate must give the candidate an opportunity to explain their position online or in person before forwarding a recommendation.
