
Umar Khalid Bail Case
New Delhi: The Supreme Court on Friday agreed to examine the legal framework governing bail under the Unlawful Activities Prevention Act in the matter involving Umar Khalid. The bench noted conflicting judicial interpretations and referred the issue to a larger bench for authoritative clarity.
Earlier in the day, the Delhi High Court granted Umar Khalid three days of interim bail from June 1 to June 3. The relief was allowed so he could spend time with his mother, who is scheduled for surgery. The court described its decision as an empathetic consideration of family circumstances.
A trial court on May 19 had refused interim bail to Khalid, even rejecting a short two-week release request. The court held that the reasons cited, including post-death rituals of an uncle, did not justify temporary release given the seriousness of allegations under UAPA.
The development follows contrasting observations by the Supreme Court in a separate matter, where a bench stated that under UAPA, bail should be the rule and custody the exception. This contrast has prompted renewed scrutiny of bail standards in terror-linked cases.
Umar Khalid is accused in the alleged larger conspiracy case linked to the February 2020 northeast Delhi riots, which left 53 people dead and hundreds injured. The case is being investigated under UAPA provisions, along with several other activists and political figures.
The reference to a larger bench is expected to bring clarity to inconsistent rulings on bail under the UAPA, particularly in cases involving serious allegations and prolonged custody. It may also influence pending bail matters linked to the Delhi riots conspiracy case and similar prosecutions under anti-terror legislation, where courts have differed on the interpretation of stringent bail conditions and personal liberty safeguards.
