CEC Gyanesh Kumar’s Removal Halted by Parliament (Image Source: Internet)
New Delhi: In a significant constitutional development, a notice of motion seeking the removal of Chief Election Commissioner (CEC) Gyanesh Kumar has been rejected by the Chairman of the Rajya Sabha, halting the process at its initial stage.
According to official Rajya Sabha records, a notice of motion dated March 12, 2026, signed by 63 members of the Upper House under Article 324(5) of the Constitution of India, sought the removal of Shri Gyanesh Kumar. The notice of motion cited Article 124(4) of the Constitution, Section 11(2) of the Chief Election Commissioner and Other Election Commissioners (Appointment, Conditions of Service and Term of Office) Act, 2023, and the Judges (Inquiry) Act, 1968.
After due consideration, the Hon’ble Chairman, Rajya Sabha, exercised powers under Section 3 of the Judges (Inquiry) Act, 1968, and refused to admit the notice of motion. The decision underscores the meticulous constitutional checks involved in such high-stakes parliamentary actions.
Simultaneously, in the Lok Sabha, a similar notice of motion was submitted by around 130 Members of Parliament seeking Kumar’s removal under Article 324. This notice of motion also referenced the Judges Inquiry Act, 1968, and relevant 2023 Election Commissioners’ laws. However, the Speaker of the Lok Sabha, after a careful and objective review, rejected the notice of motion at the preliminary stage, ensuring that Gyanesh Kumar continues in office.
