FIR filed against Rakesh Kishore over ‘Shoe Attack’ attempt on CJI BR Gavai

New Delhi: On October 6, there was a sensation in the Supreme Court when 71-year-old lawyer Rakesh Kishore tried to throw a shoe at the bench headed by the country's Chief Justice (CJI) DY Chandrachud.

Due to the alertness of security officials, the attack was averted in time. It was reported that Rakesh Kishore was angry with the Chief Justice's remarks during the hearing related to the restoration of the Vishnu statue in Khajuraho.

After the attack, a slip was also found from Rakesh Kishore in which it was written, "My message is for every Sanatani... India will not tolerate the insult of Sanatan Dharma."

FIR registered, but as zero FIR

Two days after the incident, Bengaluru Police finally filed a 'zero FIR' against Rakesh Kishore. This FIR was registered on the basis of the complaint of Bhaktavachala, president of the All India Advocates Association.

Zero FIR means that it can be registered anywhere across the country, even if the crime has occurred at some other place.

FIR registered under these sections

A case was registered against Rakesh Kishore under the following sections of the Indian Justice Code (BNS):

Section 132: Assault or use of criminal force to deter a public servant from his duty.

Section 133: Assault or use of criminal force with intent to insult.

After the FIR was registered, the case was transferred to Tilak Marg Police Station in Delhi, which comes under the jurisdiction of the Supreme Court.

Demand for contempt proceedings

There is now a demand for criminal contempt proceedings regarding this incident. Advocate on record Subhash Chandran, who represented Attorney General R. Venkataramani, has been appealed to initiate contempt proceedings against Rakesh Kishore for insulting the dignity of the Supreme Court. He said that this is a serious case of interference in the justice system.

"No regrets"

After the incident, Rakesh Kishore gave a statement in the media that he had no remorse for his actions. He continued to make derogatory comments against the Supreme Court and the Chief Justice through social media and various channels. It is clear that they are justifying their actions.

Nationwide condemnation

This attack is being strongly condemned across the country. There is a demand from lawyers and common citizens for strict action against the accused. Many people also say that if the name of the accused had been something else, strict action would have been taken immediately.
