Abbas Ansari secures his MLA status after Allahabad HC overturns his conviction
Lucknow: Suheldev Bharatiya Samaj Party MLA Abbas Ansari from Mau Sadar in UP has gotten a big relief from the Allahabad High Court. The High Court has quashed his conviction in a case of inflammatory speech, saving his MLA seat and now ending the possibility of a by-election on the seat.
Ansari had threatened state government officials with consequences if the Samajwadi Party came to power after the 2022 assembly elections. On this charge, a special court (MP/MLA Court) in Mau convicted him and sentenced him under various sections of the Indian Penal Code (IPC).

Specifically, he was sentenced to two years' imprisonment each under Section 153-A (increasing enmity between groups) and Section 189 (threatening to hurt a public servant).
Apart from this, he was sentenced to one year under section 506 (criminal intimidation) and six months under section 171-F (undue influence in election). The court also said that all these sentences will run simultaneously, and a fine of two thousand rupees was also imposed on him.
His election agent, Mansoor Ansari, was also sentenced to six months in the same case. Abbas Ansari had appealed against this decision in the lower court itself and also demanded a stay on the sentence, but his demand was rejected on July 5. After this, he filed a review petition in the Allahabad High Court.
The High Court heard the case on July 30 and reserved the decision. Ultimately, Justice Sameer Jain, in his decision, canceled the order of the lower court in which Abbas Ansari was convicted, and the way was cleared for terminating his membership.
This decision of the High Court directly means that Abbas Ansari will continue in his post as MLA. His membership will remain intact, and the by-election to be held on the Mau Sadar seat will no longer be held. This decision is being considered a major legal victory for Ansari, and it will also strengthen him politically.
