Delhi HC issues notice to CBI on Kejriwal's plea
New Delhi: The Delhi High Court on Monday issued a notice to the Central Bureau of Investigation (CBI) over Aam Aadmi Party (AAP) Supremo Arvind Kejriwal's plea seeking recusal of Justice Swarana Kanta Sharma in the excise policy case. The court said it will now hear the matter next on 13 April.
The bench recorded Kejriwal’s recusal application after noting that advance notice had been given to the opposing side and directed the CBI to file its response by the following day, according to reports from Bar and Bench.
Kejriwal, accompanied by his wife Sunita, informed the court that he had submitted the recusal plea and urged the bench to take it on record. Solicitor General Tushar Mehta, representing the prosecution, objected to the application, calling the allegations “frivolous and contemptuous,” and stated that the prosecution should first address the matter substantively.
Mehta also argued that Kejriwal should not be allowed to address the court personally unless he first discharges his counsel. “I have no objection to him appearing in person, but he has already engaged a lawyer. Unless he discharges his counsel, he cannot argue himself-if he chooses to appear, only he should represent the case going forward,” Mehta said, citing protocol.
Responding to Mehta, Kejriwal maintained that his recusal application was filed in accordance with the high court’s procedures. He also highlighted a procedural issue, noting that a petitioner appearing in person is unable to file documents electronically.
