SC upholds acquittal in Nithari Case, rejects all 14 appeal

New Delhi: A major legal update emerged on Wednesday regarding the infamous Nithari case in Noida, adjacent to the national capital Delhi. In this high-profile matter, the Supreme Court has dealt a significant blow to the CBI, the government, and the victims' families. The country's top court dismissed a total of 14 appeals, including those filed by the CBI, the Uttar Pradesh government, and the affected families in the Nithari case.

The Supreme Court rejected all 14 appeals challenging the acquittal of accused Surendra Koli in the 2006 Nithari serial killings case, stating that there was no irregularity in the Allahabad High Court's decision to exonerate him.

A three-judge bench of the Supreme Court, comprising Chief Justice BR Gavai (CJI), Justice Satish Chandra Sharma, and Justice Vinod Chandran, upheld the Allahabad High Court's verdict in the Nithari case.

The Supreme Court ruled that the recovery of evidence by the police without recording the accused's statement is not admissible under the law of evidence.

On October 16, 2023, the Allahabad High Court had acquitted the main accused in the Nithari case—Surendra Koli and Moninder Singh Pandher—in multiple cases. The High Court also overturned the death sentences awarded to both convicts in two cases.

The High Court had reversed the decision of the CBI court in Ghaziabad, which had convicted both accused in the Nithari case and sentenced them to death.

Against the Allahabad High Court's order acquitting the two accused in several cases, the CBI had filed an appeal in the Supreme Court. Along with the CBI, the Uttar Pradesh government and the victims' families had also filed appeals. They had sought the restoration of the death penalty awarded by the CBI court, but the Supreme Court dismissed all appeals.
