SC Seeks Independent Probe Into NEET Protest Violence (Img: X)
New Delhi: The Supreme Court sought an independent investigation into allegations of excessive force during protests over alleged irregularities in the NEET-UG examination. The court observed that any individual found responsible for violating the law whether a protester or an official must be held accountable through a fair legal process.
A bench headed by Chief Justice of India Surya Kant, along with Justices Joymalya Bagchi and J. V. Mohana, was hearing a batch of petitions related to the demonstrations held in Delhi and other parts of the country.

During the hearing, the Chief Justice said an inquiry would have little meaning if responsibility was not fixed.
The bench emphasised that the proposed investigation must be independent, fair and transparent, adding that the composition of the probe panel would be decided at a later stage.
The Supreme Court reiterated that peaceful demonstrations are protected under the Constitution and observed that the student protests fell within the constitutional framework.
At the same time, the bench made it clear that any unlawful acts committed during the protests cannot be overlooked and should be examined through due process.
Lawyers representing the petitioners alleged that protesters were subjected to excessive force, including lathi-charge, pellet guns, electric batons and assaults by police personnel allegedly dressed in civilian clothes. The court was also informed about claims involving the detention of minors during the demonstrations.

One of the petitions also referred to allegations surrounding the reported use of an AK-47 by a police personnel during protests in Bihar's Siwan district.
The bench indicated that existing guidelines governing police action during public demonstrations may need to be reviewed in light of recent developments.
Observing that protests are an integral part of a democratic society, the court invited constructive suggestions from all stakeholders as it considers a broader framework for handling future demonstrations while balancing public order and constitutional rights.
