New Delhi: The pleasant experience of buying a new car turned into a terrible accident for 29-year-old woman Mani Pawar, when her new Mahindra Thar fell down from the first floor of the showroom. The incident took place at the Mahindra showroom in Nirman Vihar, Delhi. The woman had bought a new Thar by spending about Rs 27 lakh, but a small mistake during the delivery of the car proved costly.

Accident During Worship In Showroom

Mani Pawar was performing a small puja and ritual in the showroom before the delivery of the new car. During this, a lemon was placed in front of the Thar parked on the first floor of the showroom. As soon as an attempt was made to take the car out, the accelerator was accidentally pressed too much, causing the speed of the car to suddenly increase. As a result, the Mahindra Thar broke the glass of the first floor of the showroom and fell straight on the sidewalk and was completely shattered.

Immediate Medical Assistance After Accident

The woman and another person accompanying her did not suffer major injuries due to the opening of the car's airbags. They were immediately taken to the nearby Malik Hospital for first aid. Both were discharged from the hospital after treatment. Although this accident became a bad memory for Mani Pawar, the biggest question for the showroom and the company now is who will bear the cost of repairing the car.

Who Will Pay Damages?

According to the Indian Motor Vehicles Act, 1988, until the car is registered and insured in the name of the buyer, the vehicle is considered the property of the dealer. For this reason, the dealer or the showroom owner is responsible for the accident that occurs in the custody of the showroom. If the accident is caused by the negligence of the buyer, such as wrong handling during a test drive, then the buyer may have to pay the damages.

In this case, since the car fell from the first floor of the showroom and the accident occurred under the supervision of the dealer, usually the dealer's commercial insurance claim will pay the damages. However, the final decision on who will bear the cost of repairs will be taken only after investigating the matter.

Buying a new car is as joyful as it is a precaution. Mani Pawar's accident is a reminder that it is very important to be careful and follow safety rules while buying. Also, both the dealer and the buyer should understand their responsibilities so that such accidents can be avoided.
