What did the court say?
While giving its verdict on the case, the court said that this law was in place since the time of colonialism, which promotes gender discrimination. According to the court,
The practice of changing the surname of women after marriage was started by Roman and Dutch law. Earlier in the African tradition, women used to keep their parents' surname even after marriage. Their surname was not changed.
The 'Births and Deaths Registration Act' was passed in South Africa. At the same time, now this act will be amended after the court's order. After this, if the husband wants, he can keep his wife's surname.
What is the rule in India?
However, South Africa is not the first country to do so. In countries like America, Australia, New Zealand and Portugal, men are completely allowed to keep their wife's surname. At the same time, there is no compulsion regarding surname in India as well. Both husband and wife can keep any surname of their choice after marriage.
