New Delhi: Gaurav Luthra and Saurabh Luthra, the owners of the famous Birch by Romeo nightclub in Goa, had sought anticipatory bail to avoid arrest in connection with the devastating fire at the club.

Considering the arguments presented by the Goa Police before the court, the court held that it was not appropriate to grant relief from arrest to the accused at this time.

Goa Police lawyer Abhinav Mukherjee stated that the Luthra brothers claimed they had no knowledge of the club's operations and were traveling due to their busy schedules.

However, the police presented several documents showing that Saurabh Luthra had applied for the FSSAI license. Saurabh had also applied for the Pollution Control Board license.

The GST license lists Gaurav Luthra, Saurabh Luthra, and Ajay Gupta as partners. The Panchayat license had expired, yet they did not renew it. All these facts clearly indicated that they were involved in the business.

Allegation of fleeing to Thailand after the incident

The Goa Police informed the court that immediately after the fire the Luthra brothers booked a flight at 1:15 AM. They flew to Thailand at 5 AM on December 7th. When the police reached their house, their mother and wife said they did not know where they were.

According to the police, this conduct indicates an attempt to evade investigation. Therefore—

  • An NBW (Non-Bailable Warrant) was issued.
  • A Look Out Circular (LOC) was issued.
  • A Blue Corner Notice was issued on December 9th.

The investigation revealed that there was only one narrow entry and exit point to the club, which could create a dangerous situation. The fire show was organized by the Luthra brothers.
