The case began when a person named Neeraj sought information under the RTI. After this, the CIC on December 21, 2016 allowed access to the records of all students who passed the BA examination in 1978, the same year Narendra Modi also passed his examination.
During the hearing, Solicitor General Tushar Mehta, appearing for Delhi University, argued that the Central Information Commission's order should be set aside as 'right to privacy' is more important than 'right to information'. The university also told the court that it is willing to produce Prime Minister Narendra Modi's degree records before the court, but it cannot be made public for the general public under the RTI Act.
Right to Information
Delhi University said that they safeguard students' information under a moral responsibility and it is not appropriate to seek personal information under RTI on the basis of mere curiosity when there is no matter of public interest. The university said, "Section 6 is clear that information has to be provided, but its purpose is not just to satisfy someone's curiosity."
The court was also told that they will cooperate in producing Prime Minister Modi's degree records, but it cannot be made available for public scrutiny under RTI.
