SC takes strict action on rising digital arrest cases; May transfer investigation to CBI

New Delhi: The Supreme Court has made significant observations regarding the rise in digital arrest cases.

The Supreme Court stated on Monday that, given the gravity and prevalence of such crimes, it is considering handing over the investigation to the CBI.

In this regard, it has sought details of FIRs filed in various states and union territories.

A bench of Justices Surya Kant and Joymalya Bagchi issued notices to all states and union territories regarding digital arrest cases.

It listed the self-registered cases filed on the complaint of an elderly woman who was defrauded by cybercriminals for hearing on November 3.

Supreme Court Takes Strict Action on Digital Arrests

The Supreme Court took note of Solicitor General Tushar Mehta's submissions, representing the CBI, that cybercrime and digital arrest cases are originating from foreign locations such as Myanmar and Thailand.

The court directed investigating agencies to develop a plan to investigate these cases.

The court said, "We will monitor the progress of the CBI investigation and issue any necessary instructions."

The bench asked the CBI whether it needed cyber experts and other resources within the police force to investigate digital arrest cases.

On October 17th, the Supreme Court sought responses from the Central and CBI in light of the increasing incidents of online fraud across the country. The court stated that such crimes undermine public trust in the system.

Aim to Provide Justice to Victims
The Supreme Court took cognizance of the digital arrest case of a senior citizen couple from Ambala, in which fraudsters had extorted Rs 1.05 crore from them using forged orders from court and investigating agencies.

The bench stated that this was not a minor crime where it could have asked the police to expedite the investigation and bring the case to its logical conclusion, but rather, it was a case where coordination between the central and state police was needed to uncover the full scope of the criminal gang.
